1. Scope

These Terms and Conditions apply to all orders placed by consumers through the online shop levans-shop.de.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

Our online shop is intended exclusively for consumers. Businesses, commercial resellers and other business customers may contact us through our B2B enquiry form to request a separate quotation. We may reject orders that are clearly commercial in nature and have been placed through the consumer shop before accepting the order.

3. Offer and Conclusion of the Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

You may initially place products in the shopping cart without obligation. Before submitting your order, you can review and correct your entries during the designated ordering process.

By clicking the final order button, you submit a binding offer to purchase the products contained in the shopping cart. The exact wording of the button depends on the selected payment method and must clearly indicate that placing the order entails an obligation to pay.

After we receive your order, you will receive an automatic confirmation. This acknowledgement merely confirms that we have received your order and does not yet constitute acceptance of your offer.

We may accept your offer within five days:

  • by sending a separate order confirmation,
  • by sending a shipping confirmation,
  • by handing the goods over to the shipping service provider, or
  • by delivering the goods.

The time at which the first of these events occurs is decisive.

If your offer is not accepted within this period, it is deemed to have been rejected. Any payments already made will then be refunded promptly using the payment method originally used.

4. Contract Languages and Contract Text

German and English are available for the conclusion of the contract.

We store the contractual data required to process the order and send you the order information by email. The current version of these Terms and Conditions is available in the online shop and can be saved or printed.

If you use a customer account, information about your orders may be available there. Contractual and invoice data that must be retained by law will remain stored independently of this.

5. Prices and Shipping Costs

All prices stated in the online shop are total prices in euros and include the applicable statutory VAT.

Any additional shipping costs are displayed in the online shop, in the shopping cart or, at the latest, before you submit your binding order.

6. Payment Methods and Due Date

The payment methods available in each individual case are displayed at checkout. Depending on the device, order value, delivery address and checks performed by the respective payment service provider, individual payment methods may be unavailable or available only to a limited extent.

Unless otherwise stated for the respective payment method, the purchase price becomes due when the contract is concluded.

Payment is processed through the payment service provider selected by you. Additional terms and conditions and privacy policies of the respective payment service provider may apply.

We do not offer purchases on account under our own responsibility. If an external payment service provider offers such or a comparable payment option, the payment claim and payment processing are governed by that provider’s terms.

7. Delivery

We currently deliver exclusively to delivery addresses within Germany.

Delivery is made to the delivery address provided by you during the ordering process. You are responsible for ensuring that the address details entered are complete and correct.

We select a suitable shipping service provider. The shipping service provider currently used as standard and further practical shipping information are stated on the “Shipping & Returns” page.

Partial deliveries are permitted where reasonable for you. You will not incur any additional shipping costs for a partial delivery arranged by us.

If an ordered product becomes unavailable through no fault of our own despite our having previously entered into an appropriate covering transaction, we may withdraw from the contract. We will inform you without undue delay and promptly refund any payments already made. Statutory rights remain unaffected.

8. Transfer of Risk

For consumers, the risk of accidental loss of or accidental damage to the goods generally passes only when the goods are handed over to the consumer or to a recipient designated by the consumer.

This does not apply if the consumer independently commissions a carrier whom we have not previously named.

9. Retention of Title

The delivered goods remain our property until payment has been made in full.

10. Right of Withdrawal

Consumers generally have the statutory right of withdrawal.

Details concerning the requirements, periods, exercise, consequences and statutory exceptions are set out in our separate Withdrawal Policy.

For sealed goods that are unsuitable for return for reasons of health protection or hygiene, the right of withdrawal may expire prematurely if the seal has been removed after delivery.

11. Statutory Rights in Case of Defects

The statutory rights in case of defects apply.

If the delivered goods are defective, you are entitled to the statutory rights. In the event of a complaint, please contact us at support@levans-shop.de so that we can review the matter and coordinate the next steps with you.

Contacting us in advance is not a requirement for exercising your statutory rights.

In the event of a quality complaint, please retain the goods and their packaging where possible until the matter has been resolved. Information such as the order number, product, batch number and best-before date, together with informative photographs, may help us process your complaint.

12. Liability

We have unlimited liability:

  • in cases of intent and gross negligence,
  • in cases of culpable injury to life, limb or health,
  • in accordance with the provisions of the German Product Liability Act,
  • to the extent of any guarantee expressly assumed by us, and
  • in any other cases of mandatory statutory liability.

In the event of a slightly negligent breach of a material contractual obligation, our liability is limited to the foreseeable damage typical of the contract at the time the contract was concluded. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the contracting party may regularly rely.

Otherwise, liability for damage caused by slight negligence is excluded.

These liability provisions apply accordingly to our legal representatives, employees and agents.

13. Discount Codes and Promotions

Discount codes and promotional benefits may be subject to additional conditions communicated for the respective promotion. These may include, in particular, a validity period, a minimum order value, restrictions to particular products or customer groups and the exclusion of combining multiple discounts.

A discount code must generally be entered in the designated field before the order is completed. It can be applied retrospectively only if we expressly offer this option or agree to do so in the individual case.

Statutory rights are not restricted by promotional conditions.

14. Minors

Orders placed by minors are governed by the statutory provisions. There is no additional general age restriction.

15. Applicable Law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer and habitually reside in another country, mandatory consumer protection provisions of that country remain unaffected where, under the applicable statutory provisions, they may not be excluded by a choice of law.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
